GPL GPL GPL GPL GPL is the best for themes i understand why cpgnuke isn't GPL because you guys don't want puke to steal your work but the thing is he can't he will break ALL themes but then more themes will be compable with cpgnuke

No.. CPG-Nuke is GPL. Certain add-ons and such are going to be OSLA.

Jamin, The best solution is to not release your themes at all...

Well this topic isn't about "Theme violence" but I would like to ask..

Can you take the 'cpgnuke' theme, customize it, and release it under OSLA?

Actualy a theme can't be a different license then GPL and this is because mostly a theme is "based on" a default theme.
So mainly everyone who sells themes under a different license is violating the GPL rules.
However no-one has ever looked into that but if you do you can actualy sue every person who tries to sell php-nuke themes.

GPL states that you may ask the author of code to allow the use of his code in other free software (see GPL section 10).
However this still means you are not allowed to sell it unless it's some sort of download/support fee.

To avoid these i'm thinking to release the dragonfly theme under a different license (LGPL) but this again will have issues with parts used from the subSilver theme.

If you created your theme from scratch and only used the current theme as reference for all options (like the {S_SOMETHING} vars and <!-- IF --> code)
I think it's allowed to have a different license, but we need to contact GNU or OSF about this.

Maybe you should consider releasing the "cpgnuke" theme under LGPL too.. Just change the image from subSilver as you said.

anyway this thread doesn't make that much sence as it was forked off another one
and i think i wound another good thing about GPL now time to get those costly themes for free

technically no, but everyone does - what the hell, it's gonna be a long list of people being sued, and I suspect it has been deliberately overlooked by developers who would lose a key component that supports their CMS.

Well word what you sell different, don't advertise as " theme sale "

More along the lines of......

I've edited X theme, and created X theme, your payment is for the graphical and coding modifcations made by myself, but not for the theme as a whole.

Surely that works?.... your selling your work and not the theme, therefore no violation right?
